1. Application for approval of foreign company pursuant to Section 433B
By virtue of Section 433B of the National Land Code (“the Act”), a foreign company may only acquire land with State Approval, 433B. Non-citizens and foreign companies may acquire, etc., land only with approval of State Authority.
(1) Notwithstanding anything contained in this Act or in any other written lawa)
- a non-citizen of a foreign company may acquire land by way of disposal under Division II;
- a dealing under Division IV with respect to alienated land or an interest in alienated land may be effected in favour of a noncitizen or a foreign company;
2. Registration of Lease (15A under National Land Code 1965)
Registration of Lease refers to the process whereby the lessee’s name is officially endorsed on the land title as the registered lessee.
The lease tenure will also be reflected on the title accordingly.

Who Can Apply for state consent Approval?
Only companies with a foreign shareholding of 51% or more are required to apply for state consent approval.

Why the registration of lease is important?
The registration of lease is to record the registered interest of the company on the lease land.
How long is the process for registration of lease?
The entire process is expected to take approximately two (2) months or less subject to the timely submission of all required documents and approvals.
How much does it cost for the registration of lease?
The registration fee is calculated at 0.5% of the consideration sum. A detailed breakdown of all additional costs will be provided together with our quotation.
Who is required to register the lease?
Companies that have executed a lease with a tenure exceeding three (3) years.
